Jean Barnard sounds like quite the prize. She apparently planned to go on a giant tour of Australia, but that was all cut short when a child screamed in her ear on a plane, bursting her eardrums, rendering her stone cold deaf. So…she’s suing, but not the one you’d think she would. She decided to sue Qantas , the airline she flew with, for not taking the proper precautions to prevent this accident. The funny thing is she never says what those precautions are.
Well, Qantas settled, although I will never understand why. I think they could have won easily. I mean, what reasonable person could expect an airline to be able to read the unpredictable mind of a child and somehow compensate for that? They did all they could, getting her to a hospital as soon as it happened.
She doesn’t help her case by writing this little snippet to a booking agent after the incident happened.
“I guess we are simply fortunate that my eardrum was exploding and I was swallowing blood. Had it not been for that, I would have dragged that kid outof his mother’s arms and stomped him to death. Then we would have an ‘international incident’.”
She also doesn’t help by dramatically stating that her life ended the day she went deaf. Only if you let it, lady.
If she was going to sue anyone, why wouldn’t she sue the kid’s parents? She might not win there, either, but at least they are the ones who will be responsible for everything he does until he’s 18, so it makes sense. Oh, I know why. Qantas is guaranteed to have money, this family is not.
